Welcome to Quince Traditions! These Terms and Conditions ("Terms") govern your use of our website, https://quincetraditions.com (the "Site"), and its subdomains, including any purchases, downloads, platform services, or content provided through it. These Terms also govern use of quinceinvitation.com, a guest-facing platform operated by Quince Traditions LLC. By accessing or using either site, you agree to be bound by these Terms. If you do not agree, please do not use our sites.

 

1. Eligibility

  • You must be at least 13 years old to access our website and blog.
  • You must be at least 18 years old (or have a parent/guardian's consent) to make a purchase or engage our platform services.

 

2. Products & Services

Digital Nature: All products available through our Site are digital downloads or web-based services. No physical products are shipped.

Usage: Freebies and linkable assets are for personal use only and may not be resold or redistributed.

Modification: We reserve the right to modify or discontinue any product or feature at any time without prior notice.

 

3. Pricing & Payments

  • All prices are in U.S. dollars (USD).
  • Payments are processed securely through third-party payment processors. Quince Traditions does not store your full payment card details. You are responsible for any associated taxes.

 

4. License & Intellectual Property

All content on this Site — including blog posts, templates, planners, designs, graphics, and the "Quince Invitation" RSVP system — is the property of Quince Traditions.

  • Personal License: Purchase grants you a non-exclusive license for personal use. You may not resell, redistribute, or claim our designs as your own.
  • Commercial Use: Use of our products for commercial purposes is strictly prohibited without written permission.

 

5. Return & Refund Policy

  • Digital Downloads: Due to the nature of digital files, all sales of printable files and digital invitations are final. Exceptions are made for duplicate charges and for file access issues we are unable to resolve.
  • RSVP Platform Services: Refund terms for custom RSVP websites are governed by Section 9 of these Terms.

6. Accounts & User Responsibilities

You are responsible for maintaining the security of any account details. You agree not to use our Site for unlawful purposes or to disrupt the Site's technical infrastructure (Firebase, Scaleway, etc.).

 

7. Limitation of Liability

Quince Traditions is not liable for damages resulting from:

  • Technical errors or download issues.
  • Failures by third-party providers (Twilio, Scaleway, Firebase, or Payment Processors).
  • Event planning outcomes; final coordination decisions remain the responsibility of the client.

 

8. Mobile & Email Communication Terms

Mobile Messaging (SMS)

By providing your phone number and proactively opting in via our RSVP forms on quinceinvitation.com, you agree to receive automated text messages from Quince Traditions regarding event updates and reminders.

  • Consent: Consent is not a condition of purchase.
  • Frequency: Message frequency varies by event; clients are limited to three (3) bulk updates per event.
  • Cost: Message and data rates may apply.
  • Opt-Out: Reply STOP at any time to unsubscribe. A confirmation message will be sent.
  • Help: Reply HELP or email hola@quincetraditions.com.
  • Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

 

Email Communications

By submitting an RSVP, you agree to receive transactional emails processed via Scaleway. These are necessary for event coordination and do not constitute marketing.

 

9. RSVP Platform Services (quinceinvitation.com)

This section applies to clients purchasing RSVP website packages. quinceinvitation.com is a guest-facing platform owned and operated by Quince Traditions LLC. It exists solely to publish event invitation pages, collect guest RSVPs, display passcode-protected photo albums, and accept photo and video uploads from guests via personalized links.

  • Inclusion: Includes a personalized one-page landing site hosted on quinceinvitation.com, active for six (6) months from the event date.
  • Delivery: Your invitation page is delivered within two (2) business days of our receiving your completed personalization form.
  • Approval & Revisions: Each package includes two (2) rounds of client-requested revisions. You will receive your page for review and may request changes at that time. Errors made by Quince Traditions will be corrected at no cost and do not count toward this limit. Once your requested changes are implemented and your page goes live, the service is considered complete.
  • Client Responsibility: Clients must provide accurate data via the personalization form. Quince Traditions is not responsible for errors stemming from inaccurate client input.
  • Refund Policy: A full refund is available up to thirty (30) days after purchase, provided the personalization form has not yet been submitted. Once your form is submitted and work has begun, the purchase is non-refundable. A full refund is also issued if we fail to deliver a functional site before the event due to an internal system failure on our part. No refund is issued where the client has provided incorrect information or where all included revisions have been exhausted. See Our Return and Refund Policy for full details.
  • SMS Credits: Each package includes three (3) SMS credits, corresponding to the three (3) bulk guest updates per event described in Section 8. SMS credits are non-refundable and hold no cash value.
  • Data Retention: Guest RSVP data is retained for six (6) months following the event date, after which it is permanently deleted. SMS consent records (including phone number, timestamp, and opt-in language) are kept indefinitely as required by law.

 

Guest-Uploaded Content

Guests may upload photos and video messages via a personalized link. By uploading, guests grant Quince Traditions and the event host a license to store and display their submission within the event's private, passcode-protected gallery. Quince Traditions does not claim ownership of guest-uploaded content. We reserve the right to remove any content deemed inappropriate. The client (the Quinceañera family) is responsible for monitoring uploaded content on their event page.

 

Photo Album Access

The event photo album on quinceinvitation.com is private and passcode-protected. Access is provided only to guests who receive the passcode from the event host. The print studio is accessible solely to the event host; it is not a guest feature.

 

10. Affiliate Program

This section applies to individuals and businesses who apply to and participate in the Quince Traditions affiliate program.

Eligibility

You must be at least 18 years old to join. Approval is at our sole discretion. We may decline any application without stating a reason. Submitting an application does not guarantee acceptance.

Commission

Approved affiliates earn ten percent (10%) of the purchase price on qualifying sales, applied to all products including digital downloads and RSVP website packages. Commission is calculated on the product price only and excludes taxes and any fees.

Commission on RSVP website packages is approved once the invitation page is live and approved by the purchasing client. Commission on digital downloads is approved on the standard monthly cycle.

Tracking

Referrals are tracked through a unique affiliate link using browser cookies with a sixty (60) day duration. Commission is credited on a last-click basis, meaning the most recent affiliate link clicked before purchase receives credit. We are not responsible for referrals that go untracked due to a customer clearing cookies, using a different device or browser, using ad-blocking software, or disabling cookies.

Self-Referrals

Affiliates may not earn commission on their own purchases. Purchases made through your own affiliate link will not be credited.

Payouts

Commission is paid once your balance reaches a minimum of twenty-five dollars ($25.00). Balances below this amount roll over to the following period. Payouts are issued monthly to the payment address you provide in your affiliate account. You are responsible for supplying accurate payment details. We are not liable for payments sent to an incorrect address you have provided.

 

Commission Reversals

Commission is void on any order that is refunded, cancelled, charged back, or found to be fraudulent. Reversed commission is deducted from your balance. Where a reversal occurs after payout, the amount is deducted from future earnings.

Disclosure Requirement

You must clearly disclose your affiliate relationship with Quince Traditions wherever you share your link, in accordance with applicable advertising and endorsement regulations. Disclosure must be plainly visible and not hidden in fine print or behind a link.

 

Prohibited Promotion Practices

You may not:

Bid on Quince Traditions, Quince Invitation, or any variation or misspelling of our brand names in paid search advertising.
Use our brand names in your domain name, subdomain, social media handle, or business name.
Promote through coupon, deal, or discount code sites, or advertise discounts we have not authorized.
Send unsolicited email or text messages promoting your link. All promotion must comply with applicable anti-spam and messaging consent laws.
Misrepresent our products, pricing, delivery timelines, or features.
Guarantee outcomes, results, or event success on our behalf.
Purchase through your own link or arrange for others to credit purchases they would have made regardless.
Present yourself as an employee, agent, or representative of Quince Traditions.

Use of Our Brand Assets

We may provide approved images, graphics, and copy for your use. These remain our property and are licensed to you solely for promoting our products during your participation in the program. You may not alter our logo, create derivative branding, or use our assets after your participation ends.

No Earnings Guarantee

We make no representation regarding the amount you may earn. Earnings depend entirely on your own promotional efforts and results.

Taxes

You are an independent contractor, not an employee, partner, or joint venturer. You are solely responsible for reporting and paying any taxes on commission you receive. Where required by law, we will collect tax documentation from you before issuing payment and will report payments to the relevant tax authority.

Program Changes and Termination

We may modify commission rates, cookie duration, payout thresholds, or any other program term at any time. Material changes will be communicated to active affiliates by email before taking effect. Continued participation after that date constitutes acceptance.

We may suspend or terminate your participation at any time, with or without cause. Either party may end participation by written notice. On termination, any commission earned on qualifying, non-reversed sales prior to termination remains payable subject to the minimum payout threshold, except where termination results from a breach of these Terms, in which case unpaid commission is forfeited.

 

11. Governing Law

These Terms are governed by the laws of the State of Florida.
